Jab ijtehad ya wilayate fqih ki bat ki jati hai to ye sawal samne aata hai ki ek gher mason kisi masoom ki jagha kaise le sakta hai. Pichle article main hamne is bat ko wazeh kar diya ke har chiz ke liye ismat ki shart nahi hai balke din main aise bhot se kam hain jin ke liye masoom hona zaroori nahi balke iman,taqwa,ilm aur adalat shart hai jaise hukumat,adalat,qazawat,shari’at ka nifaz waghera in chizon ke liye insan ka masoom hona zaroori nahi hai jis ke liye hamne bhot si gher mason hastiyon ki bhi missal di.

Is bat ko mazid wazeh karne ke liye ek aur nukte ki taraf tawajjo dilana minasib hai wo ye ki allah ki taraf se hasil hone wali wilayat ki 2 qismen hain:

1.  Takweeni wilaya

2.  Tashri’ei wilayat

Takwini wilayat ye hai ke allah ne baz insanon ko kuch khas powewrs aur ikhtiyarat diye hain jin ke zarye wo dunya aur uski makhluqat main zahiri tabdili la sakte hain ya yon kaha jaye ki ye dunya unke ikhtiyar main hai aur wo kuch bhi kar sakte hain. Jaise suraj ko wapas bulana, chand ke 2 tukrde karna, sukhe kunwe main pani le aana waghera.ye wok kam hain jinhe mojza ka karamat kaha jata hai aur inka talluq takweeni wilayat se hai.

Tashri’ei wilayat ye hai ke khuda ne apne ambiya aur unke bad imamon ko logon ke din aur shari’at ka zimmedar banaya hai. Islami hukumat qaim karna,logon ke faisle karna,adalat qaim karna,be asra logon ki sarparasti karna,khums aur zakat ke nizam par control karna,musalmanon ke dini masael ka jawab dena aur is tarha ki chizen jin ka ta’alluq tashri’ei wilayat se hai.

Jahan tak ambiya aur imamon ki bat hai unhen allah ke taraf se takweeni aur tashri’ei dono taraha ki wilayat hasil hai lekin jahan tak faqih ki wilayat ki bat hai use allah ki janib se takwwni wilayat nahi mili hai balke uske zimme tashri’ei wilayat hai.

Is wazahat ke bad koi ye nahi keh sakta ke faqih ko masoom ka darja diya gaya hai aisa hargiz nahi hai balke dono main farq hai. Jahan tak dunya ke ikhtiyar ki bat hai us main faqih ko wilayat nahi lekin jahan tak shari’at ke nifaz aur logon ke din ki bat hai us main jo zimmedari nabi ki hai wahi imam ki hai aur jo zimmedari imam ki hai wahi aadil faqih hai aur is se inkar shari’at se inkar hai.
